			<content:encoded><![CDATA[<p>When you overlay wetlands maps over the town&#39;s tax map (see below) it it clear that a significant percentage of the proposed project area contains wetlands. A close look also shows that previous development skirts but does not contain any of the designated wetland area.</p>
<p>Access to this parcel from South Creek Road would require construction in wetlands.</p>
<p>The town should require a positive SEQR so residents concerns can be addressed via public meetings before this project is approved.</p>

<p>The property is zoned farmland. Why wasn&#39;t this property rezoned via a public process with input from the public as required by state law? Runoff from this site likely reaches Little Sister Creek affecting numerous Evans Residents. There are designated wetlands all around this site. (See illustration below)</p>
<p>The images below show a considerable amount of activity is a short period of time. Where any plans submitted to town? Were plans approved by the town board?</p>
<p>The&nbsp;town&#39;s comprehensive plan includes maps that don&#39;t show the federal wetlands and tributaries of Little Sister Creek were removed. Both would be important factors when considering allowing the current actively at the Union Concrete site. Which town employee(s) removed these items from the official town maps?</p>
<p>Residents in this area don&#39;t have town water. How is the water supply being affected in this area?</p>

			<content:encoded><![CDATA[<p>The new Orchard Park police contract includes a three year wage freeze and current officers will pay 5% of their health insurance costs.</p>
<p>The Evans police contract, which was approved by the officers in 2011 but has not been approved by the Evans Town Board, includes a two year wage freeze.</p>
<p>According to Robert Freeman, Director of the Committee On Open Government, once the union agrees to the terms of the contract, the contract can be made public.</p>
<p>The Evans Town Board should post the contract online so residents can review it and ask informed questions before the board votes to approve the contract.</p>

The Evans Town Board should consider posting the agenda on the Friday before the meeting then posting amended agendas as needed.</p>
<p>All three members of the town board campaigned on running an &quot;Open Government&quot;. Complying with the new state law should be a high priority.</p>

<p><a href="http://townofevans.com/wp-content/uploads/2012/01/RunningTotals.jpg"><img alt="" class="alignleft size-full wp-image-2923" height="419" src="http://townofevans.com/wp-content/uploads/2012/01/RunningTotals.jpg" title="RunningTotals" width="303" /></a>With larger and wealthier towns&nbsp;in Erie County carying much less debt than Evans, residents should be asking town officials why Evans has more debt than all of the other twentfour towns.</p>
<p><span style="font-size: 16px;"><span style="color: rgb(255, 0, 0);"><span style="background-color: rgb(175, 238, 238);">&nbsp;In fact, as of the end of 2010, Evans had more&nbsp;debt than the nineteen towns of Elma, Wales, Sardinia, Holland, Brant, Colden, Collins, Concord, North Collins, Eden, Marilla, Boston, Newstead, Alden, Orchard Park, Aurora, Clarence, Tonawanda and Hamburg combined!&nbsp; </span></span></span></p>
<p>In 2011, another $1,200,000 then an additional $950,000 totaling $2,150,000 was borrowed!</p>
<p>When the NYS Comptroller releases its audit of Evans, it will contain recommenations for improving financial practices.</p>
<p>The audit report likely will not provide a plan for paying down Evans&#39; massive debt.</p>
<p>All water project construction not under contract should be delayed.</p>
<p>A task force should be setup to make recommendations as to how to get spending under control and investigate ways to pay down the debt.</p>
<p>It&#39;s not fair to future generations to expect them to pay for mistakes not of their making.</p>
<p>The $1,200,000 loan will have to be paid off by the end of 2012. Hard decisions should be made now or harder decisions will have to be made later this year.</p>
<p>No mater what the auditor&#39;s report says, the debt is huge and real and should be addressed sooner rather than later.</p>
<p>If Evans truly has an &quot;Open Government&quot;, the town board will post all 2011/2012 financial reports filed with NYS on their website.</p>
<p>For the last sixteen years, financial matters in the Town of Evans have been &quot;Top Secret&quot;.</p>
<p>It&#39;s time for the secreacy to end.</p>

<p>LSCS should answer the questions raised in the Sam Pinto letter ( Below ) before moving forward with a special election.</p>

<p>What is the nature of this operation?</p>
<p>County records show that this parcel&nbsp;is 29.8 acres, landlocked, classified as rural vacant and assessed at $14,900. ( <a href="https://paytax.erie.gov/webprop/property_info_details.asp?sbl=222.00-4-10" target="_blank">Click Here To View County Property Record </a>)</p>
<p>It&#39;s definitely not landlocked and not vacant.</p>
<p>Below is current zoning map. The site is zoned Agricultural &amp; Open Space.</p>
<p>Did the property owner appear before the Ag Board?</p>
<p>Why doesn&#39;t the zoning reflect the change of use? Maybe the fact that a public hearing was required to change the zoning and given the new use, town did not want to kick a bee hive?</p>
<p>Maybe town attorney J. Grant Zajas can explain how this change of use occurred and what actions, as town attorney, he plans to pursue.</p>

<p>If the property owner can get all these cars on his runway, way is town building a $70,000 road?</p>
<p>It&#39;s time to halt all work on the water project until the auditor&#39;s report is released and town knows where it stands financially.</p>
